Using obscure Section 56 of the Highways Act 1980, he served legal notices, then dragged them to court when they failed to act. Judge at St Albans Crown Court ordered the council to fix THREE major roads within 20 days and awarded Bennett £1,650 costs. “If everyone did this, we’d have lovely roads within six months,” he said. How to fill it in (super simple – takes 10 minutes)
"To …" → Full name & address of the highway authority (e.g. Hertfordshire County Council, County Hall, Hertford SG13 8DQ). Describe the road → Be precise, e.g. "London Road, Berkhamsted, from its junction with High Street to the junction with Cross Oak Road". "is out of repair" → List the problems clearly, e.g. "has multiple deep potholes exceeding 50mm in depth and 300mm in width, together with broken surfacing and standing water, rendering it dangerous to vehicles and pedestrians". Schedule → Add extra details or attach a map/photos (highly recommended). Your details → Print, sign, date, and include your full name and address.
How to send it
Send by recorded delivery (or hand deliver and get a receipt) to the chief executive of the council.
Keep a copy + proof of posting/receipt.
The council has 1 month to reply admitting (or denying) liability.
